Terms and Conditions for our young people.
The following Terms and Conditions cover both our Content Licence Agreement (the agreement between you and us regarding any content you submit as part of our Youth Panel opportunities) and our Privacy Policy (our agreement regarding how we handle and hold your personal data). Please make sure you read all of these carefully before you start using our platform or submitting any content to our Youth Panel opportunities.
INCLUSIONWORKS CONTENT LICENCE AGREEMENT
What's in these terms?
This document sets out the terms that you grant a licence (i.e. permission) to use the content you submit to the InclusionWorks VideoAsk platform or provide during our recorded live panels. Please read the terms of the content licence carefully before submitting any contributions.
Who we are and how to contact us
www.theinclusion.works is a site operated by Inclusion Works Consulting Limited (“We“). We are a limited company, registered in England and Wales under company number 14606196 and have our registered office at Preston Park House, South Road, Brighton, East Sussex, United Kingdom, BN1 6SB.

By using our site you accept these terms
By using our site, you confirm that you accept the terms of the licence and that you agree to comply with them.
If you do not agree to these terms, you must not use our site, sign up to our panel or upload any contribution.
We recommend that you print a copy of these terms for future reference.
Your personal data
Please review our Privacy Policy available below which details how we use your personal data and how your personal data may be shared with our sub-processors who enable us to provide certain functionality and services on the site.
What is a Contribution?
In this policy we use the term "contribution" to mean any and all materials, photos, images, recordings, clips and videos that you upload to the VideoAsk feedback platform or any recorded live youth panels you attend over Zoom or Google Hangouts.
We may make changes to the terms of this policy
We amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.
Uploader Pages
We will always be clear on what content we are looking for from each of the contributions you make and their intended purpose. From time to time revealing the end company that the contribution is for would create bias in the content itself. As such it may not always be clear, however, upon completion of the contribution, we can notify of the end company and you can choose to revoke your content at that time. This can be done by emailing privacy@theinclusion.works.
Use by children
If you are under 13 years old, you may not use the site. Our VideoAsk feedback platform and Zoom and Google Hangout platforms are not aimed for use by anyone 13 or under.
The use of any of our site by anyone under 18 years old, and who are not below 13 years old, is subject to the verifiable consent of their parent or guardian, and who must upload content on behalf of their child.
Contribution Licence
We take ownership of any contribution that you submit.
By submitting a contribution to the VideoAsk, Zoom or Google Hangout platforms, you grant us the right to make your contribution available for any and all purposes of legitimate interest beyond that of the initial scope.
Specifically, you grant us a worldwide, royalty-free, sub-licensable and transferable licence to store, download, copy, stream, publicly perform and make your contribution available with full rights to edit and modify your contribution. You also permit us the irrevocable and perpetual, transferable, royalty-free right to download, copy, store, edit, modify, make available, publicly perform, stream and generally communicate to the public, broadcast, create derivative works, and otherwise utilise your contribution without any restriction and throughout the world and in any and all media (and with the ability to sub-licence any of these rights). This is so that we can utilise your contribution for narrative and storytelling purposes and for any other uses of legitimate interest.
We may include other licence terms on the Uploader page or other site which you may be required to agree to which will also govern what they can do with your contribution – either to expand upon or limit how they will use the contribution.
You agree that we may edit and use clips of your contribution in all media as part of the marketing of InclusionWorks, and grant us royalty free, worldwide, non-exclusive, perpetual and irrevocable licence (with full rights to grant sub-licences) for this purpose.
We may include our branding in your contribution.
Entire Agreement
This content licence forms the entire agreement between you and us in relation to your contribution. You may be required to confirm additional rights and permissions to the company that has set up the Uploader Page as part of their submission terms.
Personal nature of the licence
The content licence is personal to you and you cannot transfer or assign any part of it.
Which country's laws apply to any disputes?
Please note that the terms of the licence, its subject matter and its formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

That's why we share everything you need to know about what we do with your personal information. We also make it simple for you to tell us what you want us to do with your data.
We aim to be open and fair in all aspects of how we collect, manage and account for your personal data.
What is personal data?
Personal data is information about you that we collect to identify you. There are a few different types of data we might receive depending on the part (our services) of InclusionWorks you use.

Some of this information is provided by cookies (little bits of computer software) that operate on our site.
If you are over 13 then you can give us your permission (consent) to record and use some data about you depending on what we are doing and hold on to it for as long as we need to.
There are some types of information we might collect from you that we are extra careful with. This information is called special category data. How do we use this information about you?
The main reason we collect your information is so that we know who you are and we can connect with you to opportunities that may be of interest to you. We ask for your consent to use your data when we need to and at other times we work on the basis that, on balance, it is fair to you (and us) to do so (legitimate interest). Such as when sharing your contributions with our clients and when using data for research purposes.
Sharing your information
We use a few different services and databases to manage your data but we do not pass your personal details on for anyone else to use outside InclusionWorks without your permission (consent), unless for legitimate interest.
Using and sharing your contributions
We share the contributions you submit with the universities, partners and organisations we work with. We do this to help them understand more about the experiences of young people around the UK. We may also utilise your contributions for legitimate interest purposes such as research, or when marketing and advertising our services. You can find more information on what we mean by contributions and how we use them towards the top of this page.
Where is the information kept?
All of the information is kept very safe in the European Union (EU). But we may use some companies who help us run our business, and these may be out of the European Union. When this is the case we make sure that they look after your data as much as we do.
How long do we keep your information for?
There are different rules for different types of data and we make sure we are following all the rules. We have thought a lot about how long we should hold on to personal data. We keep it for as long as you are using our services, and when you stop, we only keep it for two years after that.
There is some data that we need to keep for legal reasons. We have a list of how long we keep all information and what we do with it (delete or archive) when its time is up. We keep it very safe on our systems, just like you would expect us to.
What can you do about the data we have about you?
The law gives you 'rights' over the personal information that we have about you. These rights mean you can:
-
Ask us to stop sending you newsletters and to delete any information (like your email address) that we hold for that purpose
-
Ask us to stop doing anything with the information or contributions we hold about you
-
Request a detailed summary of the information we hold about you free of charge
-
Complain about us to the person who protects your privacy rights in the UK, the
Information Commissioner’s Office (https://ico.org.uk)

Change your mind about our holding your information or contributions

Ask us to stop using any of your personal information or contributions
-
Let us know if you think our use of your personal information is unfair; and
